Non-bf - WWYD pool issues

We got a new liner a few weeks abo in out ingroumd pool and there was a rip in the seam.  The new liner was installed today. In the meantime we probably lost 6,000 gallons of water from the ripped liner, the chemicals and salt that went with those 6k gallons plus. We also had to drain the pool yesterday and refil it so that is an extra 23,000 gallons of water plus $400 in chemicals and salt (we have a salt pool instead of chlorine. 

I called the owner today and all he is willing to do is give the new chemicals at his cost, nothing else. And he basically said he would hate to lose a customer but it is what it is.

So, I am trying to figure out what to do. Should I go I small claims court and hope the judge sides with us, take his offer, ask him to include a pool closing (which if he agreed I am pretty positive it would be at his cost and not free, or something else. We are probably out $700-$800 from their manufacturer's screw up, none of this includes the cost of us replacing everything the first time since we needed the liner and that part was not their fault

  • Is he a member of the BBB?

    Was there any sort of contract? Even verbal?

    The last few big home renos we did, the contractors guaranteed their work for a year.

  • I am not sure about BBB but probe contract would cover the liner and labor for it, not the additional costs we incurred due to their defects.

  • Are they claiming its a manufacturers defect? If so, I would contact the manufacturer directly. 
  • It definitely is a manufacturer defect. I would be socked of the manufacturer would give us anything directly.

    I wouldn't be. And I think they likely have a policy in place to deal with theses situations that their local distributors or installers are to follow.
