This may be a totally dumb question but I figured I would just ask.
My husband has a 3 year old daughter with his ex fiance and he currently pays child support thst comes out of his checks and he only gets his daughter every other weekend.
A friend of mine told me that her husbands child support went DOWN when he had another baby with her (his current wife). I didnt know this was a possibility? I know every state is different though.
We are currently expecting a baby together due in august so I was curious if it would alter his child support any.
I know if he files for shared custody it will go down because he would then have her 50% of the time.
anyone know anything about alabama child support laws?
Re: Alabama Child Support Question
I don't know Alabama specifically, but if your county (or, the county that has the CO/is taking the money out of his paychecks, if it's different) has a Child Support Enforcement Agency, you can call and ask them. Or talk to your attorney.
Where I live you get a "credit" for each child you have that is not from that EX that lives with you. Basically, it brings your income down. However, HAVING said child is not a reason to modify the CS (where we live), but other factors are. (i.e. it's been 3 years since a modification, the obligor going from employed to unemployed or vice versa, you have a 30% increase/decrease of income, etc.)
