December 2012 Moms

My kid just got kicked out of daycare.

Ok, not really.  But sort of.

 

He only goes about 1-2 days a week, if that.  We pay for him to go full time though, because I need to be able to choose the days that he goes.  I SAH most of the time with him, but sometimes I have to go into FI's office and do some work (he owns a few businesses and I do the books on occasion, among other things).  So anywho, we're paying his home daycare lady a full time amount for him to only watch him part time.  It was never an issue for us.

 

Well her granddaughter just had a baby.  I guess she only can have so many kids in her care at once, and this baby needs full time care.  So since W only goes sometimes, she asked us to leave.  I'm sad.  I know that it makes the most sense, since I don't NEED the care.  But we are still PAYING her full-time.  It's just weird.  I'm sad for Wyatt because he loves the kids there and he gets so excited when he gets to go.  :(

 

I don't have access to FI right now, so honestly I don't even know if this is LEGAL business.  But I guess I don't know why it isn't.  I'm just really sad, guys!

  • so let me get this straight.  She is turning down a full time wage and giving part time service.  She doesn't sound to bright.  Did you sign a contract between you are her?  I would take a look at it and see if she has to give a certain amount of notice.  ESPECIALLY since you are paying full time.

    The contract states that if either party terminates, we have to give 2 weeks notice.  She did give me that.  So I'm taking him every day for the next 2 weeks lol.

  • What do you mean you don't know if this is legal business?  I'm assuming she is a registered provider, and according to the state, she can only have like 2 children under the age of 2 in her care at any one time.  If she has another child that is under age 2 that is full-time, plus this new baby, then she will be over her limit with Wyatt, then she had to pick one to go.  It sucks, but I am sure she is watching her butt so she doesn't get in trouble from the state (who do stop in once a month at least) for having too many kids in daycare.  Not only could she lose her license, but if she has too many kids, she could lose the food program privelage as well. 

    Hopefully she gave you a couple weeks notice so you can find a new provider.  I'm sorry you are going through this.  :(

  • Aw... I understand her wanting to be able to take in her grandaughter, but that really sucks. I think you're pretty understanding though, because if it was me, and I had to start looking for daycare, I'd be pretty pissed. It's happened to me before, and it's a NIGHTMARE when you really need it.

    I wasn't jumping down your throat.  I was just saying that she just has a limit of how many kids she can have.  I understand you are upset about the situation...I get that.  Seriously though, I wasn't jumping down your throat.  I'm not like that.  As for if she can kick him out for no reason, I am not sure.  Does the contract have specific reasons for terminating a contract (I would assume non-payment, or bad behavior on child's part, which isn't the case in this situation)?

    And, for what it's worth, I didn't read HopeNotLost's post as being aggressive. 

    As a previous in-home day care worker, it happens all the time. Plus, they can always give a fake reason. "Your kid is too aggressive/needy/not ready to be around other children..." etc. Sucks, but true. There really is nothing you can do.

    Ugh, sorry.  I'm just really not ready for this yet. I'm not ready for him to grow up and go to preschool and that's the only other option at this point.  

     

    But anywho, as I said, he's not under 2 so it's lame.  It doesn't say anything about it in the contract.  Just that if either party needs to terminate, we must give 2 weeks notice.  I just need to be able to talk to FI about it, because he would know all the questions I need to ask.

    Yes, there is a limit as to how many kids under 2 are allowed, but there is also a limit as to how many kids TOTAL is allowed.

    In Mi, it's 6. But, you can get a special license to have 12, but only if there are more than 2 workers.

    So, you very could well need to get rid of a kid to stay legal, regardless of ages.

    Yup, I'd do this, too.

    I'm sorry you have to deal with this.  We had a similar situation happen with a DCP when DD was little.  Except this woman kicked my daughter out, to replace her with TWO children she was related to (so she was therefore over her limit of kids under 2).  Needless to say, I reported her and she lost her daycare license.   :)

    I didn't read it like that at all Clarissa.  She wasnt being mean.  I understand your mad, but she was just stating true facts.  My contract is written the same way.  I can terminate at any time, but must pay her for additional 2 weeks.  My sitter (who is licensed by DCFS) can terminate as well, for any reason, but has to give me 2 weeks to look for other care. 

    I can understand her wanting to help out family regardless of her losing money by losing you as a family.  If I ran an at home care, and could afford it, I would do the same.

    Good luck on your daycare hunt.  I know it's tough.  I had too look last year when I fired my sitter.

    Altoona is way far away.  We live downtown but his daycare is south of Des Moines about 8 miles.  Altoona would take about 10 minutes longer to get to.  I have another place lined up already, but I'm just sad about him losing his friends that he loves.

    She techincally gave you a reason, you just didn't like it, and she gave you the two weeks, like your contract says. I don't think it matters what reason, or that she even had to give you a reason anyway.  It definitely sucks because you liked it there, and so did W. Some daycares will give you the option of picking and changing the days he comes in, you may just have to do more searching for one that is flexible.

    I would too, but there is a huge process in in-home daycares. As I said, I worked in one, and they gave favoritism to kids that were related to them, neighbors, families that had siblings, whose been there the longest, etc. 

    It's almost as crazy as political ties. It's all about who you know, who can do favors for you, and even the parents that are willing to turn a blind eye as you "take them to mcdonalds play place so I can study for my nursing exam." (I wish I was lying.)

  • the crazy part is that out family has been going to her for 14 years. so in the politics side of things, we should have first pick over the other kids there.

  • Sorry about the situation. It stinks for your son, but I understand where she is coming from. Family comes first for a lot of people and she wants to watch her great grand-daughter instead of getting paid for a full time spot. Good luck with the new place and I hope he makes new friends quickly :)

  • I know most daycare contracts have an exit clause for both parties with proper notice given.

    It sucks.  But, it's her granddaughter.  I mean, what can she do?  In a way, I respect that she is doing it the right way and releasing a child instead of breaking the rules and hoping she doesn't get caught because your kid isn't there every day.
