Can u do anything about...

DC's other parent using "inadequate" carseats?  I just found out that DS's father bought a high back booster, and is planning to use it on our just turned 2 year old (DOB 5/28/10) with just a seat belt. He's a wiggly child and has only been turned around to forward facing for 2-3 months (outgrew seat in height). I was planning to keep him harnessed till 5 in ALL vehicles, but especially his dad's families'. 

 

Is there anything I can do? Besides talking to him, which I've already done.

We don't have a court ordered custody agreement because we've always just agreed.

  • If he's using an illegal car seat, call the cops on him.

  • Find out your state's laws, then contact child protective services if he's in violation of them. They can at least point you in the right direction, and possibly intervene. Just a note, CPS tends to go overboard sometimes...and doesn't act strongly enough when they should 

  • Don't know your state laws but just because you don't have a custody agreement files with a court system doesn't mean that you child can be transported illegally in a vehicle if it is in violation of a law. 
  • This is a tough one. Even if you have always agreed, this is the kind of situation where an custody agreement that cover every.single.thing. you can possibly think of would come in handy.

    Something like this is a safety issue and he doesn't get to just ignore it. Calling the cops sounds hash, and could potentially get CPS involved which will create a lot of drama but it NEEDS to be something he fixes. Maybe print off all the information you can possibly get your hands on and show it to him. Or since you don't have a custody agreement, tell him you refuse to allow your child to be taken anywhere by him until he gets the right seat for your child.

  • safety is number one. SS is 6 and the size of a 4 year old, and BM puts him in a base seat (just the bottom and shoulder belt). In her state (Iowa) and ours (North Dakota) we are required to have him in a harness until 50lbs. She flat out didnt care that he shouldnt be in the seat she bought and said she couldnt afford to buy a different seat. Call CPS if you feel for your child's safelty.
