Update from last court hearing for custody/visitation...

The judge ordered us both to take a drug test on Friday by 4pm. Well, I took mine right away and to no surprise my EX never showed up. He decided to take it on Tuesday afternoon the following week. Well, GREAT NEWS!!!! He failed even after waiting 5 days to take his drug test. He tested positive for cocaine and marijuana. I couldn't be more happier. What a jacked up loser. I'm thinking that he may not even show up since he knows he failed and you can't possibly get out of that. Can you? We have another court hearing this Friday. Does anyone know what I can expect as far as custody/visitation go? TIA for any insight

    HA! Sucks to be him...    he won't be getting visitation, and IF he does, it'll be supervised AFTER he completes a drug rehab program and he'll be drug tested often. If he can't stay sober, he won't be allow to be around his child because that's putting his child in danger. He could also be arrested for testing positive for those drugs. Coke is pretty hardcore.

    Were you guys ever married? If no, you'll get custody, esp after these drugs. No way in hell he'll get custody of any kind. Good luck! Let us know how it goes! :)

    Why did you have to take a drug test?

    If I were you, given that he so recently failed a drug test, I would demand a clean test before he gets to see LO.  See if you can get that in the paperwork.

    ^^This.  I know a lot of Judges in my area will actually refer the drug test to the Criminal Court for cocaine use.  I'm not sure how seriously your Judge will take the positive marijuana result (some Judges don't get too concerned with pot for some reason) but the cocaine will definitely raise some concerns.  Especially since the test was taken late.  I don't foresee you having any problems getting it put in the CO that he must have a clean drug test prior to any visits with LO.

    What happens custody wise if your ex tests positive for drugs?  My ex is threatening to enforce his custodial rights to our four month old he has never met, if I don't let him sign over his rights?

    I know I was soo happy when my lawyer called me with the news he failed for 2 types of drugs. We were never married. I left him when I was 4 months pregnant because I found out about the drugs. I hope he gets arrested for being under the influence of cocaine and marijuana. I hope that me being patient this past year has finally paid off and he'll get what he deserves for all the abuse he gave me while I was pregnant with my LO. Karma's a bit$H!!! hahaha
