Question about maternity leave

I have a somewhat complicated situation at work. I started a new job full time in Jan. I had been working at the same position PRN (at a hospital) since the previous June though. In order for me to get a paid maternity leave and be able to take a full 12 weeks which I REALLY REALLY want to do I have to work 1250 hours. I have been working overtime as much as possible and picking up extra shifts to try to get the hours needed. Right now I am thinking I will get to the 1250 hours by June 29th. I am due July 17th and this is my first baby. Do you think that give me enough leeway between when I get the hours and my due date? I haven't had any complications or problems during the pregnancy that would cause me to be high risk to go into labor early..unless being overweight causes early delivery (I have no idea if it does). I want to make sure I get my hours in before I have the baby so I can have the paid leave and take a full 12 weeks.

 Thanks

Re: Question about maternity leave

  • Wow...that's a tough question.  I also work in a hospital.  Your best bet is to talk to your benefits/HR department and see what they say.  Some might be willing to make an exception, so it's worth asking.  I think we only require 1000 hours, but I guess every hospital is different.  Good luck!  I hope it works out for you.

The best thing to do is speak with your HR dept.  FMLA has a requirement to complete 1250 hours as well as be employed FT for a minimum of 1-year to be eligible-it doesnt sound like you will meet this.  However-any company can make the FMLA benefit more accesible to an employee (for example they can just require you to work the 1250 hours and not be employed 1-year.)  You would need to speak with your HR dept to find out their FMLA policy.  Hope this helps :)

  • I'm due July 17th as well and I'm working up to July 6th. Statistically speaking, you're most likely to have the baby a little bit later than your due date.

You might find working extra hours is going to get more difficult though.  I'd talk to your employer or HR department to see if there is an option to get the leave even you don't have the full 1250 hours.

  • I would say it would be pretty unlikely that you would go into labor that early.  I'd try and get as many hours as you can as soon as possible, but more for the fact that you won't want to be working as much so close to your due date.

  • Is the question regarding your physical ability to do it or the time for your benefits to click in?

If it's the later then check with HR. I think that as long as it's done before you file your leave paperwork and disability with the state it will count.

If it's the former, all I can advise is to try your best. With my first pregnancy I was 37 yo and I worked 50-60 hours per week on my feet until 10d before I gave birth. It wasn't easy or fun but it was also unavoidable and completely doable.

just so you are not sadly mistaken (like I was) its not just 1250 hours you need...you need to be there a full year in order to qualify for the full 12 weeks allotted by FMLA.  I have more than the required hours, but since I started my job last August, I dont qualify and only get 6 weeks.

Agree with the others, its best to talk to HR because they can help clarify this all for you.

It doesn't sound like FMLA with a paid leave, just her work's policy? FMLA just keeps your benefits, it doesn't get you a paid leave. I would just keep working as much as possible and hope it works out.
