Update & need advice about dealing insurance on stolen rings

I posted last week that my wedding and engagement rings were stolen the movers during our move. I called the moving company the next morning and spoke to the lady who answers the phone. She said the owner was at a convention, but she would have him call me back. I didn't hear back from him and by Friday I sent an email again asking for him to call me and asking for their insurance information.

 She responded back that they are shocked and know thier employees would not steal, etc, and that they were seeking the advice of counsel. She said the owner was still at a convention and would be back on Monday. I emailed her back asking for thier insurance information. I got no rresponse.

 In the meantime I filed a police report and claim with my insurance company. Turns out I'm under insured and i estimate it will cost me about $3,000 out of pocket to replace my rings.

The owner called and left me a message around 4;00 pm Monday. I was at a long dentist appointment and so numbed up I couldn't speak clearly for hours. I wasn't sure if I was supposed to talk to him at this point since I'd already made a claim on my insurance. I planned to talk to the adjuster  before calling him back. In the meantime he called again and left a long message about how shocked he is and that he has reported it to his insurance.

When I called back yesterday the lady who answers was a little nasty and said "Mr. X has tried to call you back several times!" (her addressing him as Mr. X seemsso odd to me, but whatever). I ignored her comment, but did she really think that since he finally decided to return my call 7day later I should still be waiting by the phone?

Anyway, the adjuster said I could talk to him and try to get them to cover replacement cost and not put the claim on my insurance. My question is... How do I go about asking for this and getting what I want? I'm still waiting for replacement cost estimate from the designer for the setting and need to call about the cost of the stones. Anyone have advice on how to proceed?

    I'd keep on them and if you have a lawyer friend I would ask their advice. That's why companies like that have to be bonded and insured!

  • I wouldn't sweat the lack of contact the owner had; it sounds like the admin person is just nervous.  I would still proceed as though you are also sorry this happened but just want to come to resolve, esp since you are underinsured.  I wouldn't let on that this is the case (I suppose that is obvious) to the owner.  I would tell him matter of factly that you filed a police report and coming up with a replacement value and will let him know what that is.  See how he replies. 

    I would personally try to do this outside of your insurance - for the reason of being underinsured and also risk of increased rates.  We had renters insurance and when we were robbed and made a claim we were dropped.  Then, on future policies, we had to indicate whether we made a claim - and I am sure rates are increased based on this.  Lovely. 

    ETA: I would consider posting your question regarding how to proceed on TN: MM - while they can be snarky there are people with a broad range of experiences and some lawyers as well.  Can't hurt.

    Rates may not necessarily increase. I had made a claim on my jewelry (which I have a separate policy for outside of homeowners) twice in 4 months.  I have a sapphire and diamond ring that has about 12 diamonds on it.  I notice one day at work three diamonds are missing, the prong broke.  I called State Farm and they had me take it to my jeweler to fix and replace.  I never had to pay anything, they paid the jewelry store.  Four months later I notice two more diamonds missing on the same ring, called State Farm again, they said no problem to take it back to my store and have them replace all prongs (just to be on the safe side).  Each time they also appraised it afterwards so that we could be assured it was the same type of diamonds.  My policy never increased due to this.  I did add new pieces as they have arrived and it went up maybe a few cents to a dollar for the year just because the replacement value increased.

  • I'd definitely file the claim. You pay for that insurance. Your insurance company will probably going after the moving company's insurance. Hopefully you'll even get your deductible back. I would totally stand my ground on this. Also, filing a claim doesn't mean your insurance with automatically go up. And with regards to the adjuster, he works for the insurance company and if he could avoid a claim they have to pay it is better for his company not necessarily you.
