Born to American mom, in-vitro twins denied citizenship

I am super confused by this:

Cliffs Notes version: American citizen living in Israel uses DS for IVF, yet the twins that are born from this are not US citizens. 

How? 

Sidebar: Before DH was a US citizen, if we would've had kids outside of the US they still would've been considered US citizens since I birthed them so long as I did the proper paperwork which this woman was doing.  Is DS different somehow?  Weird.

  • The difference with your situation is that if you used your eggs, you are American and thus your baby is American. If you used a donor egg and DH's sperm before he was a citizen and had the babies abroad, it sounds like you'd have a problem.  They are distinguishing between the unknown national origin of the donor eggs and donor sperm (ie she probably used DE and DS from an Israeli citizen).

    LOL. It's still ridiculous! If we carry them, it is our baby. They need to catch up with the times!

  • Being abroad this is particularly interesting to me. I think the most frustrating aspect is that US citizenship can basically be bought, but since she didn't have her girls in the US there's an issue. I'm curious why they pried so much since from what I read she's listed as the mother on the birth certificate. 

    It's no one's business at the consulate or otherwise if she had DS or DE.  

    The whole birth right citizenship is largely obsolete, except for a few countries. You can see the list here: https://en.wikipedia.org/wiki/Jus_soli 

    There are even L&D "vacations" where families that can afford to shell out $20,000 can have their babies in posh hospitals.

  • the mother is an american citizen that carried the babies for 9 months and then delivered them. As an american citizen her childred have a right to american citizenship. I could maybe see the logic if they were talking about surrogacy but this is ridiculous.

    Yes  They are taking this a bit far now.
    TTC since 3/07. IVF#1 = canceled. IVF#2 = 0% fertilization. IVF#3 = BFN. IVF#4 = c/p.  
    Moving forward with Adoption 2017!

    This exactly!  If she carried the baby it should not matter.  I know for Gestational Surrogacy in most other countries there has to have a genetic link to at least one of the parents to transmit citizenship.
