Maternity Leave Laws (I'm in OH)

"  Firing a woman solely for being pregnant is illegal, according to the Ohio Civil Rights Commission. Once a woman returns to work after maternity leave, the employer must reinstate her the same way anyone else would be reinstated when returning from disability leave."

 

This is what I found.. My question is.. As a new employee am I still entitled to this? Today was seriously my first day and the doctor called this afternoon to tell me that I am to be on bed rest from today til I come in Tuesday.. And there's a possibility that it will continue for the rest of the pregnancy... Is there any chance they can tell me to just not come back after I'm let off by the doctor? That's what I'm afraid of.

  • They can't fire you BECAUSE you're pregnant. That doesn't mean they can't fire WHILE your pregnant.

     Basically, they've got to treat you just like anybody else with any other issue.

  • Being new seriously limits how protected you are.  FMLA doesn't kick in until you've been at a job for a year.  Short and long term disability is another thing that many people can rely on but given that today was your first day, you are very likely in a probationary period and not eligible for those benefits.

     This. Ohio is an at-will employment state (unless you signed a contract w/ your employer) so they can let you go at any time and they don't have to have a reason.

  • Also, if your company has less than 50 employees, they do not fall under FMLA at all no matter how long you have been there.
