I feel stupid asking this, but I really don't know the answer. I assumed that I needed to wait until after the court hearing (4-16-12) to get a birth certificate and social security number. Is this correct?
From what I understand the birth certificate will be changed by the court at your finalization, and you will be issued the new one. I'm not sure about the SSN though.
You will get a new birth cert after finalization. With the social DD had one that was given to her when she was born, but I changed it for safety reasons- I didn't want her birthmom having it. So after I got her birth cert with her new name on it, and DH and I listed as the parents- I went down to social security with her adoption decree and new birth cert and applied to change her social- it took about 2 weeks, but I got her new card in the mail, it was really easy.

Once we got the BC in the mail DH went down to the SS office and they put together the paperwork to issue DS' SS # / card. We received it a few weeks later in the mail. Up this this point of course we used a temp. tax ID number for him when filing taxes.
The SS office lady said that DS had been issued a SS number after birth and that it had been sent to his biological mother. They went ahead and issued him a NEW number and handled on their end what ever it took to retire his original number. We hope but never said anything to DS' biological mother that she did not USE his original SS # or she would be in a lot of hot water.
You are correct. Once the adoption is finalized the attorney will submit paperwork along with adoption decree to have information changed on birth certificate and to issue new social security card. Your attorney should take care of all this and advise you of what all needs to be done. Once the paperwork is sent in it can take around 6-8 weeks before you can request new copy of ammended birth certificate and then once you have that you can apply for new social security card. Hope this helps.

Okay... I got mixed reviews on what needs to happen. Some said that they're automatically issued a social security number and that was sent to the bmom? We don't have a lot of contact but I can ask her through my cousin that introduced us... I think.
Or I think some people said that they had to file for a number.... I don't know! Do you think the social security office can help with that? I just don't have any documentation other than the papers that the birth parents signed (it's notarized) also the paperwork that the lawyer filed with the court.
I know it's not the end of the world, but we're getting back a NICE refund... and I really don't want to have to wait until the adoption is finalized... best case scenario that'll be September (from what the lawyer has said). Hmmm...
You can't file for a SS# until you have a finalized adoption. But you can apply for an adoption Tax ID number. Search this info in the SS website and the form that you need will pop up. This number will be her number and you can use it on taxes to file for your adoption tax credit this year.... Like next month.
Then once you finalize and receive the birth cert in the mail take the birth cert and adoption decree down the the SA office and they will have you apply for an actual SS card. You will receive that card in about 2 weeks.

Like you mentioned in your post, you will receive your daughter's BC only after you have finalized (and it will take 2 or 3 months at least to get.)
So, from what I've learned... If your adoption is not finalized then you can apply for an ATIN (Adoption Tax Identification Number). Search for it on the IRS.gov website and it should take you to a corresponding form to fill out (or ask your lawyer if you have one.)
Once your adoption is finalized (like ours is) then you can no longer apply for an ATIN and have to figure out whether a number was issued at your daughter's birth or not. That's where I am stuck, since the SS office can't find a number that was issued at her birth they are telling me that she can not be identified and therefore can not receive a SS number.
So work on getting that ATIN processed. You will be able to file your taxes with that and then once your adoption is final you will have to work on the rest

My DD was not given a number at birth and I had no trouble getting her a SSN after finalization when I brought the birth cert and adoption decree in. They didn't give me any problems.
Now my son was given a SSn at birth and mailed to the BM. I told her to keep it as we would get him a new number after finalization and thats what we did.
