Single Parents

Anyone who has dealt with OP's and lawyers, advice please.

So, I filed for an OP against BD middle of last month and our court date is coming up to extend it (if I choose). I have decided not to extend, but today received a letter in the mail from a lawyer he apparently hired to represent him in the OP case. I was told if I didn't show for court, the OP would just be dropped. (I'm not showing because I feel the OP has went on long enough). My question is, assuming his lawyer shows for court, which he will because they have no knowledge of me not going, will he be charged for the time? I am assuming he has payed the retainer already, but was curious if me not going to court would do anything at all besides cost him money.

  • The kind thing to do is to call the lawyer and tell him that you intend to let the order expire. Otherwise it costs him money and he and the lawyer's time.

    Yes.. His lawyer will charge him per hour during the court hearing. If you knowingly do not show up then you very well could be charged to pay his lawyer fees. If you are letting the order expire why is there a need to go to court?

    Aren't you a peach? Co-parenting is going to require each of you to not piss eachother off for jollies. Grow up. There will be actual battles in the future. Save the fight for something that actually benefits your daughter.

  • Coming from a lawyer - If I represented your ex, I wouldn't necessary trust you're saying that you won't show up and not show up myself. As his attorney, I would still show up that day to ensure you didn't show up, thus your ex will probably be charged either way.

    FWIW, some attorneys do OP cases for a flat fee instead of a typical retainer with an hourly charge.
