Looks like I am not going back to work

I was told my maternity leave was over March 19, which seemed longer than I thought it should be due to the fact I took off several weeks during the pregnancy for medical reasons that cut into my FMLA.  I even expressed my surprise when she told me.  I decided 2 days ago to write her (our HR is based out of NY) and verify that date.  Well, she wrote me back and said she was mistaken and I am due back at work Feb 19!  Sunday!

I have nothing set up for babysitters, not to mention I am going to go to California Sunday and Monday and have out of town guests arriving Wednesday for a week.  I talked her into extending it for one more week to discuss things with my husband.  As I mentioned, it is very hard to get a sitter for my job because the hours are irregular, sometimes until midnight, and sometimes a normal shift of 9-6.  The joys of working retail in a casino.  We had originally thought his mother could watch her but she is going back to work and won't always be available.  My daughter would have to go around to different family members every day in their homes in order for me to work.  We have no one to come to our home on a regular basis.

So I guess I am just going to give notice.  I feel so unprofessional that I can't even give 2 weeks, since they messed up the dates of my maternity leave.  And I just hate telling my manager I am not coming back so last minute.  I consider him a personal friend.  He was my manager at my last job as well, I have known him for 5 years and he even came to my out of state wedding.

Any advice for how to word this so I don't look completely unprofessional and ill prepared for the end of my maternity leave?  I was hoping to have this door open to me in the future, but I am afraid I am now burning bridges.

  • That stinks! I would tell them that due to the misstake in your return date and your lack of available childcare that you will have to give notice. I would let them know how much you enjoyed working for them and your current boss and that you are sorry for the short notice or inconveince. If you word it kindly but also let them know that HR dropped the ball on your return date, they should be understanding. Hope this helps and good luck!

  • far as i knew FMLA was 12 weeks per calender year. So as of january 1st it started over. Or else i would be back to work already. It being their fault they should work with you and if not then I wouldnt want to work for them in the first place they made a mistake and should take responsablity. I called my boss today to see when im due back and how were going to transition me  back into work and my husband and i decided to go back part time. If i didnt have to i wouldnt go back at all. But she never called me back. ugh but my friend today called and said there is a bunch of stuff going down there. oh another thing your employer and the stat might have differnent FMLA's to go off of. I didnt qualify for my employers but i did the state so you might have more time. look into it

  • Coming out of lurking to say that depending on your state you should have 12 weeks of FMLA leave for pregnancy and also 12 weeks of FMLA for a child during a calendar year.  

    If you want to continue at your job you can request time off to take care of your child.
