Adoption

Vent: This tax season is going to suck

DW took our taxes to the accountant this morning, we've used her for years and have never had any problems with her.  I made sure DW had all of the proper documents to claim the adoption credit and when she dropped everything off, our accountant told her that she didn't need the adoption order or the AAP agreement (didn't make copies for her records either) and that she could electronically file for the adoption credit so we could get it back faster.............

I just scoured the IRS website again, confirmed that she needed the docs I sent and that it had to be mailed in with copies of those docs.  I called her and quoted the IRS website and she said she electronically filed for another adoptive parent 2 years ago and he had no problem getting the credit with the way she did it.  She went on to say that she could file a paper return but that it would take at least 3 months to get a check (I was expecting longer anyway).  DW is claiming Iz and the credit and trusts that what our accountant says is legit even though I showed her what the IRS website says.

I am so annoyed.

  • I taked with mine last year before going to the appointment that we had the adoption credit to file last year. I still printed off the IRS info and collected all my docs. and she still fussed with my while pulling out her old books. I just stated that I wanted to do it my way and I had no problem. We filed paper copies of everything so we had everything together. It took longer but it came right in and stated in the time frame of when we filed. A lot of people had trouble on her last year getting theirs back.

  • Argh, that is so annoying. You are absolutely right, you must file a paper return. Two years ago, you didn't. Get with the times tax lady!

Expect to send your paperwork in at least twice. Once with your original return, the when you are audited (not sure if the audit rates will be as high this year as they were last year). It took us a year to get our refund back for our failed adoption, but we did (Monday!)

I know there are specific paperwork requirements for "special needs" adoptions (so you can get the full refund even without expenses being paid), so be ready to have all of that at the ready.   (From the IRS page: In the case of an adoption of a special-needs child, you may be eligible for a certain amount of credit or exclusion regardless of actual expenses paid or incurred. A child has special-needs if all of the following conditions are met:

The child is a United States citizen or residentA state determines that the child cannot or should not be returned to his or her parent's home, andA state determines that the child probably will not be adopted unless assistance is provided )
  • When we got audited last year the IRS asked for document SND 1803 Which is a special needs declaration.

Our agency didn't have that document but had one entitled SFN 1084 that we submitted and the IRS accepted.

So if you don't have a special needs document yet that is something you can collect while waiting.

Make sure your acct sends it certified- that they sign for it. IRS claimed they didn't get our return last year but we were able to prove they had signed for it. (plus we had already gotten our state return back- which they won't send out if the IRS hasn't gotten your return.)

Good luck. We didn't get our return back till November (filed in March). It did come just took its own sweet time. the whole IRS this is so annoying!!
