Nanny tax question

Do you withhold state taxes from your nanny's paycheck?  If so, do you have a state employer id number, or do you just use the federal one?

    In Virginia both are a requirement. I am not sure if it is a requirement for all states.

    Yes I withheld state tax, I believe it's the law.  And yes, I got a state tax ID.

    I believe you can pay a nanny as a 1099 employee and then you don't have to withhold anything, it's her/his responsibility to take care of taxes at the end of the year.  Not sure if that's the case everywhere, but I know it is where I live.
