Random compensation question (NBR)

Ok, random WWYD question - DH recently purchased an ipad from a major retail chain, and then realized he needed the slightly better version, so he had me exchange it. While I was exchanging it, I asked them to make sure that his information was erased from it, and the girl doing the exchange went into some setting and supposedly cleared out his data. Well, very long story short, it turns out that his info was NOT erased, they re-boxed the ipad and put it back on the shelf, and someone else purchased it with all of his info on it (his email account was stored on there and logged in, and there were pictures on there as well). We ended up finding this out through a crazy series of events. DH lost a lot of emails (the person who purchased the ipad deleted a bunch of them before realizing what they were.) When we found out, we were really, really upset, because there could have been a risk of identity theft, etc.

The reason we went in to complain was because we wanted to be sure that the ipad had been erased (the person who bought it returned it when they realized it had someone else's info on it) and to ask why they hadn't contacted us when they realized they had sold our personal info (we didn't find out about the incident from the store.) The manager apologized profusely, said that the situation had been handled and that corporate headquarters was also investigating the situation, and then asked us how we would like to be compensated.

We honestly had no idea what to say. We didn't go in there expecting money or anything, we just were upset and wanted to be sure the information was no longer available to anyone else. However, the manager asked us to email him within the next few days to let him know how we would like to be compensated. He is in touch with the corporate lawyers, and I think they're trying to avoid a potential lawsuit by offering us something (we wouldn't sue anyway, it's not as if anyone actually stole DH's identity  - there was just potential for it.)

So, we're kind of at a loss as to what kind of compensation to ask for, as this has obviously never happened to us before. What would you do? We thought we'd maybe just ask for a gift card, but we don't even know how much we'd ask for. Any suggestions?

  • Honestly when we got one I didn't think i'd use it much.. but now i LOVE it.

    I use it nearly every day esspecially when I'm sitting in the bathroom with DS while he's bathing (after I've washed him up and hes having "play time") I just sit on the ipad playing games etc. Makes the time pass by lol.

    Also really happy about having one when I go  into labor this time! Last time it was so boring when the contractions were still bearable.

     

    There's so much they are good for. Like If I forgot to check the store sites for whats on sale before I get to the grocery store I just pop on ipad real quick so I can be prepared. It's Silly little things that I like my Ipad the most for!

  • To be honest, I am surprised they are offering compensation.  Most companies have it in their return policy that it is your responsibility to remove any personal information prior to returning any electronics.  They should definitely have notified you when they became aware of the situation, so they may want to make nice just to avoid any potential issues.  

    As for compensation, I would try and approach it as reasonably as possible, but I am never one who asks for a lot, so maybe someone else would have better advice.  I would ask for two years identity theft protection and maybe $100 gift card.   I am surprised they are letting you ask and not just offering something.  They normally only do that if they think that you will ask for less than what they would offer (the old salary negotiation trick of you-go-first).

  • I would say the value of the new ipad should definitely be reimbursed. If they want to give you more than that for their mistake then maybe also take back the ipad that had your info on it. That way you could feel comfortable knowing there is nothing else on it going to someone else out in the world. Beyond that...I don't know.

  • As a business owner asking for the value of the Ipad and another one is pretty greedy. As pp said you should have gone in and wiped the system and not trusted the 16 yo part time-er to take care of YOUR personal information. At most I would ask for a $50 to $100 store gift card.

  • I would ask for credit monitoring service for at least a year if not a few. I would be worried that there was some info of yours that was compromised

    Yeah I kinda agree with this... Im pretty sure they're not just going to GIVE you a new iPad.

  • Thanks for all of the input, ladies! Asking for credit monitoring hadn't even occurred to us, so maybe we'll go with that. I don't think it's ridiculously expensive, and it makes sense considering the situation.

    For the record - in retrospect, we both agree that we should've looked into how to erase the ipad on our own before we returned it. However, this particular store chain has very strict policies in place regarding identity protection, and supposedly every single employee has been trained in what to do when any type of personal electronic device is returned. It's supposed to immediately go to their IT people before it ever makes it back to the floor. Apparently, this particular employee just got busy and didn't do it. So that's why the store is making such a big deal out of it. Again, we didn't go into the store planning to ask for anything, we just wanted to make sure that the information had been deleted and ask why we weren't contacted after the incident happened.
