just a curious question...

okay so say a mother was giving birth, and something happened during the birth and the mother didn't make it. if the mother of the baby is not married to the baby's father, who does the baby go to or who is left with that decision of who the baby goes to? i know its rare for something to happen like that but its just a question out of curiosity. btw, don't know if it matters but in new jersey.

  • I dont think it matters if your married or not. If the child is his then he gets custody. I could be wrong but thats how I thought it went.

  • im just like reading the birth certificate paperwork that they gave me at my labor and delivery tour and it says on it that if the parents are not married, the father can only be on the birth certificate if we both sign it in front of a witness. so if he can't even be on the birth certificate without my permission, how would they be able to give him the baby?

  • usually if you have something in writing as the mom, even if you don't have a "will" they will follow those wishes. there could be a possible dna test done to verify he is the father, i guess i would call a lawyer in your area and ask, they won't charge you for answering a question.

  • If he has a paternity test done and is proven to be the father of the child, he will get custody (unless he is an unfit parent).  The reason he can't be on the birth certificate without your permission is because they don't require a blood test for you to put someone on the certificate as the 'father'-- legalities.

    I would make a will personally, but if he is the father, you can't stop him from gaining custody unless he is an unfit parent.

  • thanks guys!! and i would totally want him to have the baby!! lol my father is listed as my next of kin and my step mother would try to convince him into not giving the baby to my boyfriend, so im just going to have something notarized as a just incase type of thing.
