okay so say a mother was giving birth, and something happened during the birth and the mother didn't make it. if the mother of the baby is not married to the baby's father, who does the baby go to or who is left with that decision of who the baby goes to? i know its rare for something to happen like that but its just a question out of curiosity. btw, don't know if it matters but in new jersey.

If he has a paternity test done and is proven to be the father of the child, he will get custody (unless he is an unfit parent). The reason he can't be on the birth certificate without your permission is because they don't require a blood test for you to put someone on the certificate as the 'father'-- legalities.
I would make a will personally, but if he is the father, you can't stop him from gaining custody unless he is an unfit parent.
