Toddlers: 24 Months+

DH got rear ended today :(

He was on his way home from work and was at a red light and some crashed into him. The guy told DH he was checking looked down to check his xmas list!! Really!!

So DD was not in the car but what do I do about the car seat I heard that it needs to be replaced if in accident is this true?

  • As an insurance professional most companies go by national safety standards not the manual that comes with the seat. If your husband's car was able to drive away it isn't a major accident and wouldn't be replaced. If the seat was not on the side of impact it won't be replaced. That isn't to say you can't push for the seat to be replaced just giving you the general guidelines they go by. The other person's property damage liability would cover the seat if it is covered. Some companies require you to submit proof you have replaced the seat and then they will reimburse you.

  • So glad he is okay and your DD wasn't in the car! And wow, can't believe the guy would ADMIT he was checking the list! How stupid.

  • I am an insurance adjuster- and we DO go by car seat manuals ALWAYS- as this is what the NTSB states to go by.  With that being said, most car seat manufacturers advise that the seat needs to be replaced if it was in use at the time of the accident.  The insurance company WILL replace it if your car seat manual advises to do so.  If your seat belt required replacement, the insurance company would replace it- same goes for your childs seat belt.  I am glad he is ok - and check the car seat manual.
