DD's doctor just called me suggesting that I get her a law guardian since I cannot directly deal with stbxh. I will be calling my lawyer tomorrow, but for now what should I expect? I know this will be a neutral person looking out for dd. Any insight would be welcomed.
Re: law guardian?
The person they're talking about is the guardian ad litem.
Here's a definition: Guardian Ad Litem Law & Legal Definition
In my bag
d90
50mm f/1.2 * 28-85mm (Macro) f/3.5-4.5 * 70-300mm f/3.5-4.5
Opteka Fisheye Adapter * Lightscoop
A law guardian acts ONLY in the child's best interests. It doesn't mean that both parents are incompetent, it just means that the guardian will advocate on behalf of the child without regard for the parent's interests.
In a case where there is an OOP, I think it makes sense.
This is what my lawyer explained to me as well. It has nothing to do with my ability to parent my child, but so that her interests are kept front and center. My lawyer explained that she will be appointed one regardless of the situation, once a court date is set.
