need advice on child custody

ive been reading things on the internet ever since the day my lo dads mother came to my house ive been looking in child custody we were never married and my lo doesnt have his last name but his dads name is on the birth certificate i havent been able to work due to complications from my c section but he works and we both live with our parents

does anyone know if he has rights to the child at all?

ive been loooking up to talk to a laywer but i thought i would get suggestions here first so i have a clue

    Last name doesn't matter. Since he's on the birth certificate he has the same rights you do.

    Hmm nope, not true. It only depends on your state laws. BD was on the BC as soon as DD was born but he did not have custody rights until after he filed for custody and visitation.  

    ETA. Talk to a lawyer because none of us here are lawyers (except for BGG) or know your state laws.  

    good point. it does vary state to state. i usually put that when I reply. that's what I get for trying to Bump half asleep at 4am! lol. But i agree...talk to a lawyer
