Okay I'm a mother of two beautiful daughters 4 years old and 7 months old. Their father and I are no longer together! I am living in a 1 bed room apartment with my mom until I can get on my feet. I work on call and my hours can range from 0 - 24 hours per pay period. Their father on the other hand has his own place, does a least 72hrs per pay period and only supplies me with diapers and wipes once a month which I replenish again any ways. He only keeps them 24hrs out the week and I have them all day everyday but he feels that he should claim one of them. When I feel as I should and I would still give him some money. I feel like the answer is obvious... youre doing all the work so you should get the benefit.

Unless it's in a court order, or decided upon between the parents, the parent with whom the children spend more than 51% of their time has the right to claim them. IRS rules here.
Both of my kids live with me and only see their dad 48 hours a month, but I claim DS and ex claims DD because he supports them and that's what we agreed on.
Just know that technically, it's whoever does it first. My sister and her ex always fought over who could get their return in the fastest.
I made a deal with ex that whoever got the most benefit for claiming would and we would split the portion of the return relating to kids. However, since he owes a crapload of back support, I always claim and keep it all.
