  Sounds like it will be another 1st gen , which is weird that they would have enough of those still laying around.  Oh well, still a new one.

  Hmm, mine might actually qualify. I'll have to check it tonight. That stinks that you only get a new 1st generation. I've been secretly hoping for a reason to upgrade to the new nano.

  did it have to do with a class action suit? i remember getting the paperwork for it.. but i never filled it out.

  I'm not sure.  I got an e-mail from them a few days ago and ignored it until I saw the recall on the news.  You can check the serial number on their website to see if yours qualifies.

  I found my old 1st Gen Nano, and it qualifies. Boo to getting a replacement 1st Gen. .. I was hoping for an upgrade, too.
