ok, so this might be long and need advice

Situation: The people above us moved in in September and have been making noise no-stop like they are doing construction all different times of the day and night (i.e. 1030pm, 11pm, 230am). It is a "mom" (I put it in quotes cuz I saw her all dressed up for a club or something at 1030pm leaving and her attitude) and two teenagers. I have not talked to any of them face to face. So, they have been complained about to our manager by two other tenets other then us. And when my manager talked to the "mom" she said that she "wasn't going to change her life style for anyone".

Recently my manager asked if they have gotten better with the noise and I said no. And she told me to write them a letter....uh, ok, like that is going to go over good, idk. My manager said that our property managers were going to give them a warning letter, did that happen? Idk.

And today, Caleb has a cold and he hadn't taken a good nap this morning, so after 2 hours of trying to get him to sleep, 20 mins later they come in a loud pound was made on the floor and woke Caleb up, now i'm PISSED. But luckly he went back to sleep.

So, what I'm asking is: Would you go talk to them face to face (bring DS along)?  Would you write them a letter (but it might come across wrong)? Would to call the property managers? WWYD?

  • I would not write them a letter - that could come off completely not the way you would want and create friction. I would go with DS and talk to the "mom". But, unfortunately, you wouldn't be able to address any noise during regular hours but rather the late at night ones. And I would do this soon so you can use the excuse that Caleb is sick, not sleeping well, etc. I would say something like "I'm so sorry to bother you but we live downstairs, Caleb has an awful cold and isn't sleeping well at all day or night, would you guys mind keeping the noise down after 10pm?"

    See how that goes - if not well, call the manager. If it goes well but she doesn't do anything about it, I would call the manager. But I would definitely talk to her because you see how well it's being handled by the manager.

    Good luck - svcks that you have to deal with inconsiderate neighbors when LO needs all the TLC you can give!

  • I agree, no letter. I would take your LO with you, hoping to play the sympathy card. It does stink to have no choice in that matter, and they should be being considerate. Its the same thing as me letting the dogs out at 230 am, and if one of them barks, I get them in as quickly as possibly. Its just rude at that time of night.

  • I wouldn't confront them in any way that they'd know who I was because a) I'm a chicken and b) I'd be afraid of retaliation. We are in a similar situation with the people that live below us. I have only complained to management because I don't need them making more noise than they already do.

    Document every time they make noise and complain every single time. At one point it got so bad that I started an Excel spreadsheet of type of noise, date, time, and duration. Things have gotten a little better after many neighbors complained multiple times. I know they will never get kicked out because there is nothing in the lease about quiet time/noise pollution, so technically they aren't doing anything wrong.

    Our lease is up anyways so we are moving (for more than just this reason, but it's definitely a huge plus). If our lease wasn't up, I'd talk to management about letting us out of the lease without penalty or moving to a different unit within the complex.

    I agree with this. I had a similar situation a few years ago. My DH said something to our ahole neighbors and they were total jerks and just got louder. We complained all the time to the managers, our other neighbors complained as well..we ended up moving because of it..Good luck..sounds like your upstairs neighbor is a piece of work..ugh..

  • I would call property managers. Make sure they have gotten their letter and complain about the noise. I would also go speak with her facee to face without LO. I would try to be nice and completely honest. But if she gives you any attitude at all I would be a complete b*tch to her.
