Frustrated with midwife's response about stopping work

I stopped working at 37 weeks with DS, solely based on how I was feeling.  She let me just pick my last day and had me tell the receptionist.  She just didn't want it to be before 36 weeks because my school district would probably call her to ask why.  I'm 36 weeks now and hoping to make it to Halloween (37 1/2 weeks).  She told me that she doesn't think she can legally say that I'm done until 39 weeks without citing a specific medical reason.  She's going to check with another midwife.  I told her about what I did with DS, but that didn't seem to help things.  I teach kindergarten and have ups and downs, but there are times during every day where I feel like I just can't do it anymore, particularly in the afternoon.  I'm just not sure how I can possibly make it to 39 weeks!!!  Everyone I work with is always asking me how I'm feeling because I think I LOOK like I'm not doing that well.  Anyone else in a similar situation?  Or know anything about this whole 39 week thing?

  • I know I had to have a specific diagnosis to get short term disability before delivery. I didn't anticipate leaving work before I had LO, but I had to due to complications. On the paperwork from my job to get short term disability, the doctor had to list the specific pregnancy complication and there was even a code...

  • You should ask your employer. I just had a meeting with HR to figure it all out and what they told me was if I take off prior to delivery with no medical reason then they are fine with putting it towards FMLA but its unpaid. And if I have a reason it can then go towards short term disability.

  • That seems pretty normal. You can't stop working (and collect disability) because you don't feel like working anymore. Being 37 weeks pregnant isnt a disease that means you medically cannot work anymore.

  • If you take FMLA (without pay, or using your vacation time) they legally can't ask you why.  If you want disability pay, you have to have a valid reason/complication.

  • Um, yeah.  You can't just get a fraudulent doctor's note to allow you Disability just because you don't feel like working.  I worked up until the moment I went into labor at 40 weeks.

    Be thankful you don't have an real medical reasons for needing to stop work.

    They can very much ask you why. And they will. It's a FAMILY and MEDICAL leave act. Not a hang out at home and know ones gets to know why act.

    I work in HR and this is absolutely wrong. You have to get a medical certification filled out by your doctor stating that you are physically unable to work. Without that, you don't quality for leave.

  • I'm going to talk to my union rep who knows everything there is to know about maternity leave in my district.  I certainly wouldn't be stopping early just because I don't feel like working anymore.  Especially one day earlier this week, I just felt in my gut that it wasn't healthy to be feeling the way I am while I'm at work.  I don't just have a desk job where I can sit as much as I want all day.

  • I'm sure it varies by district.  When I was pregnant you had to work up until you went in to labor or you had to have a valid medical reason to not work and you had to supply documentation.  I was lucky that I went into labor on the last Sunday of spring break so I got 8 days to myself before giving birth.  If he had gone one more day my water would have broken everywhere in front of my 20 kindergarteners!

    This.  I'm a teacher too and will work until I go into labor.  I have no paid leave either, so I want to save all of my time until after the baby comes.  You just can't stop working because you don't want to work.  Being pregnant/tired is not a medical complication.
