Massachusetts moms - daycare ?

Our center told just told us that it's a state regulation that if a child is prescribed an antibiotic, they must be on that med AT HOME for 24 hours before returning to daycare.  Note: they are not talking about being contagious.  They are literally referring to the med, regardless of reason.  Aiden just got a round 2 of antibiotics for a stubborn ear infection yesterday and they let him stay there since he hadn't had a dose yet (see what I'm saying about it not being related to them thinking he's contagious - even though ear infections aren't anyway).  But they said if we dosed him last night he couldn't come to daycare this morning.

Every reference I can find online says that a contagious child has (like with a fever) has to be out for 24 hours and that the first dose of a med can't be given AT daycare but I see nothing about the regulation this daycare claims to be following.  I'm wondering if anyone else's place claims something like this or if I should dig further in order to prove her wrong.  It's a giant PITA.

  • I have not heard of this. Maybe they are concerned about an allergic reaction to the antibiotics? But I can understand the contagious thing...but if they are on antibiotics it just doesn't make sense!

  • Sorry you day care is being such a PITA and sorry my response is so long. I hope it helps. We live in Mass and DS who is 2 has gone to day care in Mass since he was 3 months old and here is what I have encountered.

First, I have never been required to keep DS out of day care if he is being treated for an ear infection with anti-biotics as long as I have a Drs note saying this even if he has a fever. Ear infections are not contagious. The cold that gave them the ear infection is. A cold in an of itself (no fever, vomiting, diarrhea, etc.) is not something that my day care regulates. If they did my kid would never be able to go, he always has a cold this time of year as do most of the other kids.

I do need to keep DS out if he has a fever (considered 101 or above) if it is not ear infection related (e.g., virus). I can't bring him back until the fever has been gone 24 hours. I think the exception to this is if DS is diagnosed with something like strep which is treatable with antibiotics that he has to be on the anti-biotic for 24 hours before returning to day care.

This all makes sense and would be what I would assume.  When I talked to the daycare director last night she said as long as he isn't contagious she, personally, doesn't mind him being there but that it is state mandated that when a med is started it must be administered at home for 24 hours before the child can return.  I said ok so the FIRST time ever of a med?  So if he's been on the med before that's ok?  She said no.  If he gets a million non contagious ear infections and gets amoxicillin every time, the 24 hour rule applies EVERY time. She's full of crap and I'm trying to figure out how to address it.

We follow this same policy. I've never had to keep DS out for abx/EI before. In fact, he was dx'd with an ear infection one morning and I gave him his meds in the car before I dropped him off at daycare.

I would ask to see the documentation of that regulation. I wish she had just said it was their center's policy instead of trying to blame it on the state.

  • I would think that by saying she doesn't care but it is state regualtion maybe her way of saying don't tell them if he is on meds for ear infection at home or always say he started yesterday.

  • DD is starting daycare next week and I just took a look at the handbook.  It says nothing about having to wait 24 hours after a new med, just that the first dose cannot be administered by them.
