  we put ours up high enough that it wouldn't have to be mounted on the baseboard trim and the other side we had to put a 1x4 running the length of the post so that we had a level surface. We used huge zip ties to keep it in place ... it might not look perfect but if it keeps the kid from falling down the stairs it works for me.

  We have this gate at the top and bottom.  https://www.amazon.com/gp/product/B001OC5UMQ It's a tension mount but to use it at the top of the stairs they provide cups that get screwed into the wall.  For your other question about uneven space and banisters, that's how the base of our stairs is (baseboard/wall on one side, square banister bottom/round banister top) and we got this: https://www.amazon.com/gp/product/B000P007FI
