question about court date!

so i have my first ever court date oct 3.

on the paper i got it says its for "establishing parental rights" ..
im thinking that my sperm donor wont even show up.

the reason we are going to court is because i want to get full custody of B.
so if he doesnt show up then what? do they just give me full custody or what?!

im nervous! i havent seen sperm donor in forever, hes never seen brayden and knows nothing about him so idk what to expect when i go!

  • I just went through this process.  And Sperm donor did NOT show up, as expected.  All I can say is it makes it sooooo much easier getting what you ask for!!!  I still had to make a parenting plan.  That of course said: child will be with the mother mon, tues,wed, thurs, fri, sat, sun, all hours of the day.  All holidays.  I will make all health, school, religeous.......ALL decisions regarding the baby.  But because I have never told jerk face that he cant see the baby,  I still wrote: The father may have visitation upon request, with reasonable notice, under my supervision.  && I got just that.  So they said put everything you want in this parenting plan, because going forward that is how it is going to be.  All court documents that I filled out, had to also be sent to him.  Which made me nervous knowing he was going to read every single thing I said.  But whatever.  He didnt show, and I cant tell you how amazing it felt to hear a judge say: The STATE OF COLORADO, gives you full custody of this child.  This is my first baby, and not a planned one.  So to hear that gave me so much confidence that I am an amazing mom.  Well I already knew that.  But the state trusts me enough to do this.  ahhhhhhhhhhhhhhhhh I just love my baby!!!!

    i hope my court date goes that well :) im pretty sure hes not going to show up, in my state you have to take a paternity test to prove who the father is if you are not married. (i think its like that in most states) but he didnt show up for that either so we have to go to court for that also.

  • well because he signed the birth certificate and acknowledged he is the father i dont think we had to go the paternity test route.

     

    And if he did want it, he would have had to pay for it.  

     

    but i will keep my fingers crossed for ya!!!!

     

     

  • well the test was free since i filled for it becuase i had to do that to file for CS. so since he didnt show up for that one, when we go to court for that hes going to have to pay for that test. which makes me laugh because if he wasnt so stubborn he wouldnt have had to pay for it but to bad for him.

    but one thing i am also confused about is we havent gone to court for the paternity test yet but i have a court date for custody. i havent even gotten a court date for that either.

    i dont know if that matters though.
