CS Question with back story

OK, a little back story and then my question: BD and I were childhood sweethearts separated by a move, and found each other again 13 years later in a chance meeting in random parking lot and were together pretty much from that moment on.  Two years later I got my BFP (January of 2010,) he was gone by April, I had our son in September.  He was working when we got together, and then decided to quit work and go back to school.  We had an agreement that I would support us and as long as he was in school he didn't have to work.  Two months after we split he quit school and never got a job.

I filed for CS back in November, and he KNEW I had filed, but it took 7 months to get to court.  So, June 2 we go to court, he was ordered to pay the equivilant of 4 weeks of daycare a month and it was ordered to begin August 1st.  July 29th rolls around and I text him to ask if he's going to have his child support on the first, he replies no.

So my question is this...  What recourse do I have and how long do I have to wait?

  • You contact your enforcement officer.  But in my state, the payor needs to have missed the payment by the end of the calender month before they consider it a late or missed payment.

    Also it depends on your states/county's backlog and how many cases each enforcemnt officer is working if there will be anything "quickly" meaning within the next 6 months.

    The entire backstory is irrelavent.  Doesn't matter what arrangements you had while together.  All that matters is you have a CO for CS starting on whatever date and by the end of the calender month if he hasn't paid, he can be considered in comtempt of court.

    But they usually try to work out a "deal" or payment plan to get him back on track before the bring in back to court

  • Thanks Sweetie!  I know the full back story isn't relevant to our CO per say, but it makes me feel better when explaining for those I'm explaining it to, to know that I didn't just get KU but some random jobless loser.  ;-)

    And if you did...who cares!  Nobody can judge you unless there is anyone on here that has never made a mistake.  Your baby deserves support...loser or no loser. Wink

    This.  The date a support payment is ordered to begin and the date it is due by are two different things.  My XH tried to claim I was late on his spousal support payments because he didn't get a payment from the Support Clearinghouse on the 1st of the month the support began.  The fact is that all his support payments are garnished from my wages and his first support payment was deducted from my first paycheck of that month, so he didn't see any money until the 15th of the month and even then it was only half the ordered amount because I get paid twice a month.
