Here is a "short version" of what happened.... We were driving yesterday and approaching a green light going about 45mpg (the speed limit). Right as we got to the intersection, a truck waiting on the opposite of the road decided to turn left, which went over our lane of traffic. He had a yellow blinking light when means yield to oncoming traffic, but go if no one is coming. Well, we slammed on our brakes and to avoid hitting him head on, my fiance swerved the wheel and bearly missing him and bearly missing the power pole, we ended up on the curb with half of our car in the brush. The entire front axel needs to be replaced. New wheel, new tire and new bumped. As soon as we got home, since the insurance company wasnt open yesterday, I filed a claim online. I then called his insurance company to make them aware of what happened, just in case he didnt. Well, come to find out today (we havnt spoke with the claims department yet, just the office lady at our local insurance branch that my fiance called this morning) his insurance will most likley not cover the damage because there was not an actual collision with him. Soo, is this true? The fact that he went on a yellow blinking light, when our light was green and cause us to swerve and cause us to get in an accident... that doesnt matter? Since we didnt actually hit him, his insurance company says no way?? OMG!! Please tell me this isnt true... or if it is, how is that even right?? UGH

Unfortunately, because your fiance swerved, whatever he hit was failure of avoidance on his part. It really sucks that it works that way, but when you don't hit the person who is in your way and hit something else...your fault.
Do you have collision coverage to at least cover the damages to your car?

Wow... the guy was total douche bag too!!! He admitted to me that he saw us coming, he knew we had a green light, but that since he decided to go, we should have slowed for him!!! Well, we did slow... but, he decided to go right as we were approaching the intersection... we didnt have time to stop! If we would have hit him, we probly would have been injured bad!! A head on going 45mph... NOT GOOD!!! and yes, we have full coverage, but a $1,000 deductable... Our wedding is in 2 weeks so ALL of our extra money has gone to that.. UUUGGGHHHHHH!
Yikes that's rough...but $1000 is honestly better than being injured or having to pay for the entire repair yourself. I am glad you area both OK.
I'm sorry you're having to deal with this, but I'm glad everyone involved is physically unharmed. It really could have been a lot worse.

Yes, I am glad we are all okay.. LO was in the car too. VERY scary. It definetly could have been soooo much worse, I am very thankful!... It still sucks tho and is totally unfair that the a$$hole wasnt paying attention, caused the accident, but he gets off with no consequences! UGH... Hope we doesnt do this again and end up killing someone!

Did the cops come and was there a ticket issued? If there was, Is it a possibility for you to sue him? I know that's not anything you probably want to do- but I would look into it since it's his fault (esp. if there's a ticket).
Unfortunetly, other posters are right, usually this is not covered by the other persons insurance. However, a lot of insurance companies will waive your deductible if the accident wasn't your fault. So in this case, as long as you got a police report that notes the other driver at fault, your insurance company may not make you pay the $1,000. It's worth asking. My insurance company just as a policy always waives the deductible if the accident is not your fault, and a lot of others might if you ask. My sister asked her company who did not typically do this, and when they said they don't, she commented that "so and so" company does and maybe she will look into switching there, and they went ahead and did it for her. It can't hurt to ask. Good luck.
You have probably already thought of this, but just a reminder to get a new carseat for LO. And honestly, the less they know, the better about the carseat. Just say that you need to make sure that the carseat is replaced. They will probably have you fax in a reciept. If it's about the time to get a new one, consider submitting a reciept for a convertible seat. The less the adjuster knows the better...I hate when people tell me that they will just get the next step up, and then I have to inform them that they are only able to be reimbursed for what the type of carseat that they had...but if they did not say anything then I would have covered it (I'm a claims adjuster and run into this all the time).
But find out what they need from you before you go out and buy a new one so you don't end up being out any money. Some companies want you to turn the carseat in to them, some don't care. But I also reccommend cutting the straps and writing on it with permanent marker the date of the accident so no one else can use it.
That's a Michigan broad form specific coverage, it's the only state like that. If you are less than 50% at fault then they will waive the deductible. Though there might be some endorsements on the policy that would allow for a deductible waiver in other states.
I called the cops and they came, but said in the state of Oregon, unless both vehicles have damage, or there is an injury, then they dont do anything. The officer just assisted with insruance info exchange. So, no ticket :-(
