Question about Birth Certificate

Having the father's name not be on the birth certificate means nothing in terms of custody, correct?  If his name isn't on there but he wants to act as a father, all he has to do is get a DNA test to prove he's the father and he can still receive legal consideration as a father, correct?

  • That is correct. Your EX still has to file for visitation and custody. Did he sign the Paternity Affadavit at the hospital?

  • in some cases if he signs the birth certificate it is an omission of paternity. you have to double check your state laws.. where i live if the child is born out of wedlock, and until there is paternity paper work filed with the court system, he has no legal rights over the child (visitations etc). when filing the paternity paperwork there is a box to check off that says something like 'start custody proceedings'
