Asking for a friend. Child support and pat. test

A friend of mine went through a crappy relationship for 4 years and when she ended up leaving, she got with another guy and turned up pregnant a month later unsure of whose it was. Fast forward to now, she has a 1 month old and things aren't going so well in the new relationship and they wanna split. He thinks of that baby as his own even though they aren't sure it's his. A test was never done, but I have a feeling it's the ex boyfriend's. If they separate and work out a custody agreement, does a test have to be done? As far as I know he has no problem paying child support so it wouldn't be a fight to get money from him. Would he have to adopt??

This looks like a bunch of rambling BS. If anyone got through this I'm sorry, because it probably doesn't make any sense and kinda looks like a clusterfuck. But she wanted me to ask so there it is.

  • She really needs to do a paternity test and go after child support from the biological father. He's only had one month to "think of the child as his own". I doubt he'll last 18 years paying child support if she isn't his.

  • If they want to work out a verbal agreement that's up to them. Or they can meet with an attorney to have documents drawn up and filed with the court if they want to have an official court order. If they both agree and sign the papers then a paternity test won't be needed. I *think* that once there's a court order the guy can't change his mind and ask for a paternity test.

  • In many states if he acts like a father for a period of time a court could find him to be the de facto father even if she were to protest and he were to be found to be biologically unrelated to the child. If she seeks cs through the court either she or he could request a paternity test, otherwise he can probably just sign an acknowledgement of paternity and skip the test. However, if the bio dad were to change his mind and want visitation he may also get it.
  • If he signed a paternity affidavit when the child was born then he is the legal father and has rights to parent and a financial responsibility.  However HE can challenge later if he has reason to believe he is not the biological father and a paternity test will be done to release him from the legal obligations.

    doesn't the CHILD deserve to know who their biological parent is? Don't they deserve to know who they look like, what characteristics they have? Come on. Tell your friend it's time to step up and be a parent which means doing what's best for the child and not what's easiest for her.
