XP NBR: Unethical RE agent - can I do anything (long)

DH & I are renting an apartment we found through a real estate agent.  From the very beginning, the list agent has been very uncooperative/aggressive.  Yesterday afternoon she emailed me the lease for the apartment. DH & I signed and gave to our real estate agent at 9:45am this morning.  At 4pm she sent me an email that if she didn't have the signed lease by 5:30pm today, she was going to call off the deal and move onto other applicants. We gave a check for the security deposit when we offered to rent the apartment that has already been cashed by the landlord.

I politely called and said that I had dropped off the lease with my real estate agent this morning and I'm sure she would have it as soon as possible.  The list agent said that my agent has promised to send it by 6:30pm but that's not good enough, she wants it by 5:30pm.  I asked why. 

She said "To be blunt, I'm not happy that you are working with another agent and I have to split this commission in half with her. I have my own client that is now interested where I could keep the whole commission.  It doesn't make me happy I have to split this AND wait."

Question: Is there some sort of board of real estate agents that I can complain to? This seems very unethical to me.

  • There is but realistically, nothing will probably be done.  My husband is an agent and being an a$$hole isn't illegal and very common.  There are LOTS of bad agents out there that I have heard much worse stories than yours about.  If you really want to complain though the best thing would be to call the agent's Office Manager and tell them about it.  They may or may not do anything as it would be your word versus theirs and you would want to wait to do it at all until you have the contract signed by their client and fully accepted and you have a fully executed copy in hand.     One would think that in a business that is so dependent on reputation and referrals, people would be a little more classy.

  • Unfortunately unethical does not equal illegal. You can file a complaint with your state real estate commission and they will be required to investigate the matter. The fact that they've already cashed your deposit check shows their intent to sign a lease, regardless of whether they have or not yet. Make sure in the future that checks are not given to the landlord without the signed contract in hand first. At least where I am that's how it works.
  • Contact your local DRE (Department of Real Estate).

    Also send her an e-mail and cc her and your agent as well as her boss and if you have it the Sellers as well confirming your phone conversation that you have already dropped of the signed contract to your agent and that although she should like to kill this deal and go with her renters so she can double end the deal, you have done nothing but act in good faith and will take her to small claims court as well as report her if she kills this deal knowing that the contract has been signed and returned to your agent.

    Do not have any further correspondance with her other than in writing...I'm actually shocked you have had any corresponadance with her at all, your agent should be handeling all of this for you.

  • Both my sister and my Aunt are RE's in Miami.  They deal with this kind of bitchiness/unprofessionalism all.the.time.
