Question about getting paid under the table (re: CS)

If STBXH gets paid under the table how do they calculate CS? And, will he or his boss get in trouble with the IRS for this?

  • If he is getting paid under the table I don't think CS will be calculated based on it, and they certainly can't garnish wages.  if he's refusing to pay CS because this is how he gets paid you might consider turning him in.

    Then how will CS be calculated? Will they assume he makes minimum wage and do it that way? I dont know if he'll refuse to pay or not... I'm very tempted to turn him in, and I'd be a little surprised if the judge/whomever is in charge of this doesnt think anything bad about it.  Getting paid under the table is illegal is it not?

  • Getting paid under the table is illegal.  It means he is not listed as an employee of the company.  He is getting paid without taxes being taken out or his wages reported to the IRS.  This is payroll fraud for the company and tax fraud for him.  BOTH the company and he will have heavy fines to pay.

    There is a link on the IRS website to turn in tax evaders.  You may get a "finder's fee" if they recoup the tax money.

    Also if you can prove to the CS moderator who sets the CS level, either by regular bank deposits or some sort of statement of pay he may have received from the company he works for under the table, they will investigate the company and can supoena the payroll records.  They could base the CS based on the regular and timely deposits as what he makes. 

    None of this is new the CS moderator or enforcement offices.  They all do this.  They try working under the table until the company wants to let them go b/c of goverment sniffing around their books.  They try changing jobs every 3 months or so to stay ahead of the wage garnishment...that gets old after a while b/c finding jobs are harder and harder to come by and jobhoppers aren't welcome.  Sometimes they just stay unemployed but then the CS still accrues at the level they have the POTENIAL to earn.  And owed CS doesn't go away after the children turn 18.  CS arrears will be reported on their credit report, they won't have a valid driver's license, they can't have a passport.  Judgements and liens can be placed on any property they own.  Tax returns and bank accounts can be confiscated and used to pay the arrears.

    You bring  in as much information as you can about where he works.

    Yes, it is illegal. And CS can be calculated on his earning potential. They would look at his past employment (where he was paid a wage) or what type of work he does or is qualified to do and what he would earn if he was paid normally.
