My head is spinning :o(

Ok I could just cry. I'm surprised I haven't. We've had tenants in our home in Delaware for just 6 months- in 6 months- they've destroyed our house! The smell from their dogs is horrendous- couple different carpet guys who went in told me they've never smelled something so horrible in their entire careers (including cleaning up after a person laid dead on the floor for 2 weeks- now that's bad). So the carpets been removed now and the carpet guy said he treated the subfloor but two different people told me hasn't. It's so hard to manage all this from so far away! Luckily my dad has been going and following up on it all..

We had a Realtor "Managing" the property but she obviously did such a $h!t job, we are going to contact her broker - we want all our management fees back. We sent her there a couple months ago when we had complaints about dogs in the house- we can the tenants permission for two and the neighbor said they had 4. It took her 3 trips out before the tenants admitted to it. We gave them the choice of moving, paying more pet deposits, or getting rid of the dogs. The Realtor should've told us the state of the house.. I am certain it reeked then. Why didn't she tell us that?? We would never have let them stay. And now she tells us we may not be able to keep ANY of their deposit - well if it's so hard to keep a deposit, she should have told us that then too. She has been neglectful as the tenant.

We are PISSED. The way they left the house goes so far above normal wear and tear- its complete neglect. I realize you take a loss on renting and you need to paint, carpet, etc- but all that should not have happened in 6 months time. The house was in great shape, now its a stinking mess :o(

  • I have no advice as I've never been a landlord, but I've been a renter for years.  I can't believe some of the stories I've heard (even my current landlord was dealing with something nasty at one of his other properties).  I really hope you can keep their deposit and find someone else to manage for you.  How frustrating!  Hugs!

    If the amount of damage they cause exceeds the amount they paid in deposit, why would they get anything back?

    I hope you are able to go after the property manager for her obvious culpability in this issue. That is just devestating. I am so sorry you have to deal with this!

    I know it makes NO sense - realtor has a whole host of reasons she keeps spitting out at us. We are in the process of composing a letter to her broker to go over our list of concerns.

  • If your father had access make sure he gets in there and takes pictures of everything so you can document the damages. I wonder if there's a professional certification board you can report her to. There has to be a grievance committee or something. And you damn well can keep the deposit. They can take you to small claims court to try to get it back but if they damaged the property beyon wear and tear an they violated the lease with the dogs, it's yours. My sister and her dh have a super fancy condo in Chicago that they rent out and some u of Chicago law students trashed it. Trashed it. Ruined a bathtub. Somehow messed up the finish on the floors. Pulled down curtain rods. Ridiculous stuff. They kept that deposit and probably could hbe gotten more in damages.

    It's hard to keep the deposit when the Realtor has it and won't fork it over!! That's why I'd rather do it myself next time- look what having a Realtor did for me- nothing!! We are going to complain to her broker next. Yes, my dad took pics but you can't capture a STINK in a photo! Luckily the carpet guy said he'd testify. What a mess!!
