NBR: Last Will and Testament

Does anyone have a will? I'm wondering how you went about getting it, lawyer, online? I'm clueless so any help would be appreciated!

  • I am working on it.  Our finanical planner is pushing us.  lol!  He said, as a start, you can just type out (or even hand write) you wishes and have it notorized.  He said it is the least you can do so that your kids go to whom you want, instead of the state.  Then we will goto a lawyer later to get all the small details down.

    we have prepaid legal and they typed everything up for us after we filled out a long form...then we had it notarized

    i think legalzoom and a few other online legal sites will create a will for you for a small fee (probably less than a lawyers office)

    We both have one.  SUPER important.  Everyone wants to think that the family's will cooperate if something should happen to both of you, but sadly when emotions are high this is not often the case. 

    In our wills we stipulate who should get the children in the event that both of us die and also that our estates be held in trust to be managed by a third party.  1/2 the trust will be released when they reach 30 and 1/2 when they reach 40.  

     

  • If you are comfortable with it, you could do it via a home program like Kiplinger's Home Attorney.  I am a notary public on the side and lots of people do it.  In VA if it is not done by an attorny, it has to be notarized to be legal.

  • Thanks for all of the advice! I'm wondering, can I specifically state in my will that both sets of grandparents need visitation. I trust the person we have decided to leave LO with but can I make a stipulation or no?

    I have one. I did it online with legalzoom.com and I am very haooy with it.

    I felt it was a MUST for me as a single mom with a shady X to have a Will. This way there is no question on who I want to have Caroline should something ever happen to me.

  • I want to add a personal story - the one that motivated us to finally create our will. I have a friend from high school who was in a horrible car accident, with her husband and baby in the car, on Christmas Eve. Both she and her husband were killed, along with the elderly couple that hit them, The baby survived with broken legs and is now completely fine. They did not have a will and the state is going to determine custody of the little girl. There are multiple relatives that "want' her.

    Moral of the story: GET A WILL.
