Preliminary Hearing Questions

For those of you who went through the formal divorce process:

What was the preliminary hearing like? What is actually said/decided there if anything? If mediation is ordered, is it ordered at the first hearing or the final?

TIA, mine is coming up next week and I think understanding more about it will help me feel more at east about it and not nervous.

  • We were able to avoid a preliminary hearing because XH and I agreed to terms for a temporary stipulated order - how much CS he would pay, visitation, etc. while we figured out everything for the final divorce decree.

  • They set ours for mediation a few weeks after.  That's where you go and *try* to agree on terms.  We went and agreed so the mediator wrote up the report, which got put into a temporary court document.

  • I'm sure all states are different, but it sounds like a preliminary hearing is where temporary orders are issued for custody/parenting time/child support? If that's the case, mine was called on conciliation hearing.

    STBXH didn't show up to our conciliation hearing, so I was awarded everything I was asking for re: custody/parenting time/child support. Had STBXH shown up, we would've discussed temporary orders and tried to reach some agreement. At the end, if we didn't reach a mutual agreement, the conciliator would write up his/her recommendation and a judge would put it into an Order, effective immediately. No questions asked.
