Can I ask you ladies a question?

Sorry to inturde, but I think this is the best place for advice....

I have a 19YO sister that is 8 weeks pregnant. She told the "father" and he ran off to central cal. His Step mother called and said that she was going to "take the baby" from her because she is young and stupid enough to get pregnant..... (that is beside the point)
I am just wondering, what can she do to establish sole custody? To give a little beacground...... he was here on a student visa until his 18th birthday, and now he doesn't exactly have that "status" anymore. I am just wondering, even if he is "illegal" can she still file for Child support once the baby is here?

Thank you for any insight that I can give her...... She is scared and confused.

  • She can only file for child support if she chooses to legally acknowledge him as the father. This would include a paternity test. If he "ran away" he clearly doesn't want to be acknowledged as such. And in this case, it sounds like that might be the better scenario.

    If she doesn't put his name on the birth certificate, she would immediately have full custody. If the father doesn't agree...he would have to take her to court to order a paternity test to prove he is the father...it depends on whether you think he would go through all the effort to jump through the hoops. The only thing his step-mom can do is help him do that.

    But I really don't see ANY WAY that the step-mom can "take the baby." That's ridiculous.

    Thank you dear. I agree with you about the whole "take the baby" thing. This lady is a loon, I just ask because the poor thing is scared. I told her if nothing else she and my neice or nephew can live with us for a while. THank you very uch for the info. I'll pass it on.
