Another FU to Smoker Neighbors

Sorry, this is the 3rd post on these people... I am just really stressed and could use any advice or consolation!

For those of you bumpies who don't log on, I posted another entry yesterday about the lovely neighbors I have.

Some more stuff happened. After DH came home, I told him about the smoke (in the privacy of our own living room), and a few seconds later she starts complaining to her friend sitting there. "I've lived here for years and this *** thinks she's gonna come around and set rules for the porch, blah blah blah" And yes, I can hear everything plain as day. DH got pretty angry about it, but he's super passive and non-confrontational... So he's like let's take a walk, he changes out of his work clothes and we step outside and she gave us a really fake smile. I smiled back, genuine, because I was just relishing the immaturity of this 30-something year old woman. As we were walking away I decided to glance back and she flipped us off! REALLY!???

SO today, not taking the advice of the you guys, because I suddenly got fired up about the situation on my walk from Bio lecture to the library, I called the landlord. She told me to move the benches to the other side of the porch and let me know if there are any more problems... 

And this whole time I forgot to mention the kicker: her husband/boyfriend/whatever is a maintenance man! I am so uncomfortable with the thought that he has a key to my house. The only reason I haven't just broke my lease and ran is because he is actually quite pleasant to me. And the time I had the convo with her where she agreed to smoke somewhere else he was there, which I suspect is the reason she was pleasant then. 

But seriously, if I feel one iota of hostility from her or if she moves the benches back (seriously, she's so immature I expect she will) I will write a formal letter to the landlords. I just have no idea how to do so... Any suggestions?

Also: these people have their own balcony on the back of the house. WTF!? SMOKE THERE!

AGH sorry for dragging out this ordeal, but thanks so much for all your support ladies!

    Honestly, I would move. I know it is a huge pain, etc. but it is going to be much worse if there is smoke smell in the house and you have a little baby in the house. I would write a formal letter to your landlord letting her know that aside from the smoke filtering in the house, you have been happy living there. Let her know that you would need the situation remedied on a permanent basis or you will be moving out in 30 days (or however long you would like to extend it). You should get your deposit back as well and I would site a statute to back you up or just tell her that you are due your deposit because the apartment did longer fit the use that you had intended it for...safe/clean. See if that works. Not sure the statutes in your state but worth a shot. Or perhaps she is just nice and will give it back to you especially if she can relet the place easily! Good luck!

    Honestly, we would move, but its just DH and I in this area. Most of our friends have moved away and only SIL lives around here and she wouldn't help us move and I just don't know how DH would do most of the moving himself... Plus our deposit for the apartment was pretty big and I don't want to lose it.

    HOWEVER, the plan is to move if we have another issue... between the stanky fridge and the neighbors I don't care how charming the inside of our house is. One more problem and thats IT!

    I am glad that the landlord knows. Hopefully the benches will stay where you put them. I totally agree with you though, they should be using their balcony.

    Besides moving the benches, buy a HUGE potted plant or something to place near your window. Something that you contribute to the porch and would like to look at out your window... and by HUGE I mean hella heavy for her to even think about moving! ;)

    gross!!!! eff that for sure. That woman should be ashamed of herself and her nasty smoking!!!! You are pregnant for god's sake- and she is giving you attitude and the finger for not wanting to breath in her cancer smoke all day long. 

     

    ugh!!!! I am so mad for you- what a selfish ***. I would move for sure- just post on craigslist for $12 an hour to help move, you will get a lot of response.
