FU: To smoker neighbors

If anyone remembers me posting about my smoker neighbors heres a little follow up.

As per most of your advice I had a talk with her, very polite, not too drawn out, not too quick, about how I was pregnant and the smoke gets right into my living room etc.

She responded , "well I've been here for four years and we've been smoking there for four years" and I said, "I don't mean to be a pain in the butt, but is there anyway you can smoke on the other end of the porch or maybe upstairs on your balcony?" To which she told me the landlords had them install the benches so they could smoke RIGHT THERE. BUT she said, "I get you though, I'll smoke somewhere else because I tried to stop when I was pregnant with Heidyn" I said thank you, we talked a little about Heidyn, but I had to get going.

Last night she was smoking in the same spot when I came to sit down and how could I tell? Her stupid face was peeking through the 3 inch crack in my curtains!! Like, nose pressed up against the glass, cigarette hanging out of her mouth staring into my living room! I didn't say anything, then today I wake up from a nap (I woke at 6 am hoping to study all day- that worked out really well hardy har) and the whole effing house smells like smoke. And she is out there with 2 guys and her son complaining about me as soon as she sees me through the crack in my curtains and she is undoubtedly high because she started singing, "ohhh today is a beautiful day the day I wish every day was like" WTF!?

SO now, I am going to the landlord and asking them if they can do anything about it. If they replaced my crappy door and windows then I wouldn't smell anything, but I am sure it'd be easier for them to just get the smokers out of that nook. Right now, I am lighting candles and can't air out the house because thats where they were smoking and I think it would destroy the purpose!

ETA: My head is pounding from the smoke/smell.  :(

    It WAS up in August, but we renewed back when we found out I was pregnant... We didn't want to deal with the hassle of a move when I was ready to pop... This was before we had these issues.

  • That is awful! And for a woman who realizes she even would have liked to stop when she was pregnant to still be so disrespectful. I mean.. how hard is it to go to a different end of the porch? You really didn't ask for much.

    You tried, and I'm glad you're going to the landlord now.

    Part of me thinks it might be hilarious to find something super annoying to put out there that would work off a motion censor (awful music, weird flashing lights, etc.). That might be even more hilarious now that we know she gets high.

    I hope this gets resolved for you quickly and without much more stress.

  • If your neighbor has been smoking in that same spot for all this time, how didn't you notice the smell of smoke in your living room until now?

    Either way, your neighbor sounds like a real peach.

    They didn't start smoking down here till the weather got a bit warmer...

    I think she may have last fall, but I attributed the smell to the previous tenants as we didn't move in until August and it got chilly pretty quickly this year... I spent a good amount of time over my October break scrubbing walls and shampooing the carpet.

  • I would demand that your landlord somehow fix it ... and if he does not than I would move.  It's just not right for you to have to be surrounded by smoke while pregnant. And if he wanted to take me to court for breaking my lease I would tell him to go right ahead. Nothing is more important than the safety of your unborn child.  Good luck; I am so sorry you've been put in such a terrible position.
  • If they don't fix the issue, I think you have a good case of your living there being a health issue and they should let you out of the lease. Check your local laws. They have a responsibility to provide you with a healthy living environment, and this certainly is not. Get it in writing right away and send a letter or email to your landlord as the first step in the process. They will know you mean business and either fix the problem or let you out of the lease. Sorry you have to deal with this.

  • Just wanted to voice my sympathy. I've been in that situation before and it sucked. My neighbor smoked so much that I have clothes and luggage that still smell bad, and we moved out three year ago! I used to wake up with sore throats every day and threw up in the morning at least once a week (and no, I wasn't pg-- I swear, I had way more morning sickness back then than I did during my first trimester of pregnancy!). The only plus side is that we complained so much to our landlord that he allowed us to break our lease-- which worked out for the better, because we also hated the location and were dying to move somewhere else!

  • That is awful!!! I am so sorry that talking didn't work. I had no idea you were dealing with a crazy person. Wink Hopefully the landlord will be able to help you out. I would get some clothespins to hold those curtains shut in the mean time!

    Totally agree and I would even send your letter certified. People, landlords especially, take that very seriously. They realize you are building a case. Good luck and keep us posted.
