maternity leave question for teachers

Does anyone know if school vacation counts as part of the 12 workweeks guaranteed by FMLA? I'm 39 1/2 weeks, and after tomorrow, I don't think I can make it back to school next week -I am completely ineffective at this point, and my sub is all ready to start. But, if my April break counts as a workweek, I may have to go back for the last 3 days of school... which would be pointless & which would seriously disrupt bf'ing

  • It DOES NOT count.  (YIPPEE).  I confirmed this with our HR and it is also on the website for FMLA.  It states 12 workweeks.  An entire week off is not considered a workweek as you could not work if you wanted to, so it does not count toward FMLA!!!  This was amazing news to me as my last day is tomorrow and I thought I would have to go back for a week.  I don't.  Off until after Labor Day!  Best wishes to you and good luck...For the record, double check with your Union rep and HR person so you have it in writing, even email confirmation, which I have, just in case you need it later.  The FMLA website also states that if you are provided the wrong information by your employer, it is their fault and they have to kind of suck it up.

    This. I work HR for a school district and handle all FMLA requests and this is how our policy is stated. I would however, as PP stated, confirm with your union rep & HR advisor to be sure or for your peace of mind.
