Modification of visitation?

Does anyone know how easy it is to actually try to get a modification? Do you just have to lawyer up and submit a request or is it more difficult than it seems.

I've been warned by my attorney that although I have a very good chance of having STBXH's requests for visitation denied while he's in prison, the fact is he's their father and can always apply for a modification to this down the road.

Getting a lawyer will never be an issue for him since his parents will pay anything to help him stay in the kids' lives. It makes me so mad that there's a possibility that he can pull this crap in the future.

  • Not sure where you live but where I am, all you have to do is have your lawyer make a motion for a modification of visitation. The judge should grant it since he's in prison. Once he's out you could either fight visitation all together or ask for supervised visitation.

  • I'm just lurking but . . . at least in my state you have to show a substantial change in circumstances to have a modification of custody or visitation, it's not a matter of simply applying and having it granted.  Not sure if that's the case in O-H-I-O.
