? Regarding court/mediation

I'm not sure exactly how this works. Do you first have to go to court and request mediation? Or can you request mediation from the start and not have to worry about going to court and all that?

I'm planning on getting a consult with an attorney ASAP, but I wanted to see what your experiences were. I have no clue what I'm doing here, and am completely overwhelmed at the moment. Also, if it matters, we live in FL. TIA!

  • In our county, mediation is required by the courts and you have to do it within so many days of filing the petition.  If you settle together at mediation, you don't have to go to hearing or a trial and have the judge decide.

  • typically when you go to court, you have to wait to meet with a mediator to work out the petition on the summons. If you and your x come to an agreement, then the paperwork is drawn up, you both sign it, and you go before the judge saying that you both agreed to and signed the resolution without being forced to do so. If some of the topics are rsolved, but not all, those that you agree upon w the mediator are written down and you sign. for the issues you dont agree on, (or all topics of that is how it goes) you go before the judge and plead your case. he or she takes it under "advisement" and will mail you their decision in the mail. they have the final say... you can appeal it, but for the most part that will just piss them off. depending on your state depends on the ruling. I am supposively in a pro mother state- yet my x got eveyrthing he wanted be "he is a father trying to be in his child's life" and the judge likes that he is representing himself... which allows him to lie about everything and plea ignorance later.
