Had my modification hearing today

I was dreading seeing him but thankfully the Gods intervened!!  His car broke down on the way so I got there and he participated by phone.  My support was lessened as I knew it would be since he had found a job with lower income.

In PA its basically you make this, he makes this and that's it.  They don't really care that he lost his job due to his fault and could be making more.  It's just cut and dry numbers.  I just didn't want to see him.

    I'm glad you didn't have to see him, and if you are okay with the reduced amount, then that's great.

    But my attorney told me differently, and I am in PA as well. When H lost his job due to his attendance, she said she would argue his 'earning potential' and try to have support based on that. It didn't come to that because he ended up getting a similar paying job and we agreed to an amount on our own, but she said it is a common argument.

  • It sucks for me cash wise because it is a reduction and I could use the money.  But I mentioned earning potential and he said that the amount was too big based on the living wage factor.  Right now he doesn't have a living wage since the difference in wages is too great.  (It wasn't a 1.00/2.00 drop.)  If they took earning potential into it.  So I guess they took some because it did drop but not as much.  It could have dropped another 150.00.
