types of custody?

So I'm trying to figure out the different types of custody arrangements & which type I want To try for. LO primarily lives with me but her dad watches her on the weekends when I work. He just has her from 11PM -1PM the next day when he drops her off on his way to work. So I know its joint custody but I'm unsure of how physical/legal all that works? Also- will it matter that I live with a roommate right now?I'm the one who had to move out of our home because when we bought it we only did the loan in his name?. Will it affect a custody aggreement that I don't have my own place yet an he does? TIA!!!!!

  • did you talk to a lawyer before moving out of the home?  regardless of whose name the loan is in if you both lived there as a married/domestic couple you should have been able to stay.

    i would retain a lawyer and get access to your home.  the roomate could hurt you especially if he makes accusations of romantic involvement which is very common.  courts frown on that.

     

    physical is who the child lives with most of the time.  legal is making the decisions re: healthcare, religion, education, tattoos/piercings before legal age.  things like that. 

     

    ETA: this is also based on what i know in my state from going through that.

  • Thanks for the clarification! I'm hoping to meet with a lawyer this week. My roomate is a girl, his sister actually. Its only been 2 weeks so hopefulty I can find my own place in a month or so but my financial situation sucks riGht now after being on maternity leave for 3 months with no income. I guess I want joint physical custody & joint legal. Is that normally how it works? Thanks

  • Ah.. yeah if its a girl you're fine.  As long as she's not a drug addict or hooker or anything.  

     

    And yeah you need to hash out custody (physical and legal) and also visitation.  Like... you could have sole legal and physical custody but he could have visitation with LO.  Lots of things to consider, and worth the investment in an attorney.  It gets hairy sometimes.  Even if it's amicable.  You could probs go to legal aid if you dont have the money, too.
