More headstone drama! Lawyer ladies???

It has now escalated to needing an attorney! H's cousin is a lawyer so I am going to call her in the morning but I need some advice! This has been going on for 7 months and as of right now the stone is still not correct. The contract I have specifically states that it's supposed to be installed within 8 weeks of payment which was made in July or Early august, I don't have it in front of me right now. Anyway I made the owner meet me at the cemetery on Thursday to show him that the bear on the headstone wasn't secure and with the push from ONE FINGER I was able to push the thing over. He tried to convince me multiple times that I am stupid but i wasn't backing down. He sent me a text message today saying it was now fixed. The only reason he did that is because i was PROMISED on Thursday by his installer that it would be corrected by Saturday morning and when I went Sunday and saw it still wasn't fixed I sent him a message asking him why. I'm at a loss! I know that if they did in fact go today we are going to have issues with it holding up because he himself told me multiple times it had to be fixed when dry and warm, neither of which it is today! I'm beside myself! I am so mad!!! I want to hire an attorney and make them come take their piece of crap back and give me a full refund as well as pay the difference it's going to cost me to buy the same thing elsewhere. Is this possible? Is it reasonable? Honestly if I showed you the chain of text msgs. You would see how this guy contradicts himself over and over and leads me on for days and even months that something will be done. The actual stone itself isn't even correct but it was close enough that I was willing to live with it because I am so tired of dealing with him. Now I want it all corrected! What would you do? Sorry for the lack of formatting and horrible typos, i'm on my phone.

  • Good God April, I am so pissed off for you.  That's completely out of line and unacceptable.  I don't have words strong enough for what you have been through with these people.

    I hope you get some good advice here.  You need to be made whole and you need closure.

  • Are you serious?!!???   Put this guy out of business!!  Run his name through as much mud as you can.  I would do it if you give me their names!  Can you call Howard Aim or Tom Mattaris?  I wonder if they would help you get this finally taken care of.  Karma will come back around to him.   Messing with a parent who has a loss like yours will end him in a bad, bad place for eternity.

  • I am going to look online tomorrow at contacting Howard or John. I'm furious! I want to stay as professional as I can but it's getting really hard to do! I just want to drive to his office tomorrow and beat him down! He's a little weasle and I could totally take him! FYI for anyone who has to purchase a headstone any time in the future, check out my facebook post for the name o the company. I don't want to break any bump rules by posting it here.

    You can print out the text messages if you have them saved, so you can keep records of his responses to you. Usually you just go into your service provider's "store" and they can handle it for you.

    Just thought I'd save you a google search.  My MIL was on not too long ago, and they got her problem fixed.  I can't believe they have dragged it on for this long.  Did you pay with a credit card?  There may be a way to get your money back through that.

  • Unbelievable. Does this man understand you have lost your child!?!? How could someone be so misleading and deceptive in this kind of situation-- does he have no heart? Honestly, it would be unacceptable to treat people like this with the death of a parent or a grandparent. But it almost seems worse because you are dealing with a child's death, I have to say. It makes him seem like more of a snake than he might normally be. I'd say you should serve him with papers and see if it gets done. I'd be beyond furious if I were you. You do NOT deserve this and I think you are being very strong about the whole thing.

  • That is beyond ridiculous.  I can't believe the runaround they are putting you through.  Definitely get a lawyer involved and get everything you can from him for the mess he's put you in, not to mention the cost and stress from all of this.  I'm so sorry this is still going on after all this time.

    My husband used to sell Cincinnati Bell, so he said they can even print out text messages from their customers. I'm sure a big company like AT&T could handle it no problem.

  • Ugh! I am so frustrated for you!! This is completely unacceptable and like TeacherJess said it seems so much worse because it is a headstone for your sweet baby :-( I would definitely contact the news guys and make a BBB complaint if you havent already. As for the lawsuit stuff I believe that you could sue him for a complete refund + the difference of what its going to cost to get replaced correctly. We are currently in litigation with a guy that was supposed to do our roof. We are suing to get back our money and the money we are going to have to spend to get it done correctly-- you could PM Jscaggs and ask her opinion, she is who is doing the legal work for us. I hope you can get this squared away and quickly and I will be keeping that companies name in mind and letting everyone I know know about how horrible they have been towards you. ((hugs))
