You can still claim him as a dependent on your 2010 taxes (you'll need to get a Tax ID number), but you won't be able to claim the credit until the year you finalize. We are in the same situation with DD2 (born Sept 2010, finalized Feb 2011).
You have to have provided support for the child for 6 months. It's controversial as to whether birth mother expenses apply.
If you took the baby home from the hospital and no one else provided support, you can claim a child who was <6 months old as of 12/31.
This. We tried to claim DS2 on last year's taxes but BM received his SS card in the mail and claimed him even though she never even saw him much less having him live with her. Someone reported it and we received a check from the IRS

Wow--that really gives IA a big disadvantage. I would have loved to have claimed DS--especially because we paid fees that went toward his care.
