PTO for FMLA

Hi!  I figured you ladies would be the best place to ask, since FMLA (paid v. unpaid) can vary by state.  I'm trying to accrue as much vacation as I can before we get pregnant.  My STD covers 60% of pay while I'm "disabled".  Can anyone tell me how long that typically is?  I assume it's different for regular delivery vs. c-section.

  • My STD was 6 weeks for normal, 8 weeks c-section unless a dr. provided a note otherwise.

  • FMLA doesn't vary state by state. It's federal and the same everywhere. FMLA is unpaid, but certain states and/or companies have maternity leave benefits that are paid. They can be taken concurrently, but FMLA never requires a leave be paid. 

     

    as for STD, in my experience, it has always been 6 weeks vaginal birth, 8 c/s.

  • FMLA is the mandated number of weeks off an employer is required to keep your position available for your return. It's unpaid, but you can take up to 12 weeks per calendar year for various reasons: pregnancy/new baby, death in the family, mental health, addiction recovery, etc.

    Whether your employer pays all, part or anything at all during maternity leave depends on the size of the employer, type of benefits they offer and the state you live in.

    I think 6 wks for a normal delivery and 8 wks for a c-sect are pretty standard. I had to use one week vacation before my STD benefits kicked in and then I was paid 60% for the remaining 5 weeks of medical leave. After the initial 6 wks was up,I was paid out any remaining vacation time I had banked.

  • My STD was 6 weeks.  It was not different because I had a c/s.  That was kind of disappointing.  I thought there should be at least some upside.

     

    So yeah, 6 weeks.  Like PPs said, FMLA is never paid.

  • Thanks everyone.  I probably worded it wrong.  I understand FMLA, but some states (CA, I believe) offer state covered STD.  Sorry I posted and ran, but the 6-8 weeks answered by questions.

  • You probably need to call your STD insurance company - with my first delivery, they gave me 8 weeks for a c section. The second time around, they changed insurance companies and I only got 6 weeks for a c section. I was a little peeved.
