Long story short I was laid off and rehired but now only part time not my regular contracted assignment (Im a teacher) so the weeks I do not get my 38 hours I am supplemented with unemployment benefits..
I didnt know that you cannot collect unemployment benefits when you are on recess. I was paid for the week of Thanksgiving and then told it was an overpayment since I was on break. I was also told I would NOT have to pay the money back, since I was unaware of this, and that the money owed gets taken out of my remaining benefits. Then 3 weeks later I get a letter asking to pay back the money! I filed an appeal saying that I dont dispute I was overpaid, but I was told directly I wouldnt have to pay the money back. Now I have to go to a court hearing.....because I have time to go to some court hearing at some unknown date when I am almost 37 weeks pregnant!
Xmas break: Week of 12/20 I write on my form ON RECESS 12/23-1/1 will return to work 1/3 (I was told to write this by EDD after my first accidental overpayment). Low and behold I get paid again. I call EDD and ask 5 times are you sure this is not an overpayment. They said no since I could have worked half the week I still get paid. I cash the check, spend it, since I was repeatedly told it was OK
Check #3 I call AGAIN saying why was I paid the week of 1/1 I was on recess. The guy says it was an error and to send the check back, fine I figured this...then he says he needs the last check back too?!! Wait, what?!?! I told him I was told directly by EDD that it was Ok to cash it and now I have to do another Interview and will probably have to pay that back too.
Just found out if you cash an overpaid check you have to pay it back + an additional 30%. I now owe EDD over $1,000.
First the heater, then my windshield in the new car, and now this......I seriously cannot win. It is not my fault the people there are complete morons!! .
EDIT: sorry in advance if you work for EDD, the ones I have spoken with in CA are morons.

Thanks! I just wanted to vent. I am thankful for unemployment benefits, but I am starting to think they are worth more hassle than what it is worth!
