I take out the max for dependant care flex spending, which is $5,000. I also take out $350 for the health care flex spending for copay, med the usual.
This might be a dumb question, but DH just got a new job which is why I ask.
If DH doesn't take his new employers insurance and stays covered under mine, can he still put money in his own health care flex spending or would he need to be on his company's insurance to qualitfy?

As far as I understand it, the FSA is unrelated to insurance. I think he should be fine to contribute to his FSA whether he's on your insurance or not.
This is correct. For daycare flexible spending, there is a family max of $5000.
