NBR: Car accident/insurance q...

So we were in a minor fender bender last night coming home from childbirth class. ?We were stopped and the other driver was at fault and admitted it. ?There were only minor dents/scratches on both cars. ?The other driver doesn't want to go through his insurance and would rather us get estimates and would pay for the damage out of pocket. ?Is there any benefits/drawbacks for not going through his insurance? ?

  • There really is no drawbacks for not going through his insurance....as long as he is someone who WILL pay.  However, you can always turn the claim into his insurance at any point...so if he up and bails then you can move forward with his insurance.  A lot of people do this...it will end up saving him money in the long run.  I would make sure to get some sort of documentation from him about his request.  That way you can at least have that to fall back on if you have to move forward with the insurance company.  You also should have his insurance information already....it is required by law that both of you exchange information at the scene of the accident.  :)

  • If your sure none of you are hurt and its just some scratches there shouldn't be any problems, and actually it is common as accidents can reek havic on your rates.  Make sure that you get estimates for the damages and tell the repair places that they are paying out of pocket so you need them to account for anything that could go wrong.  Make sure to write up some sort of contract with these people saying that they are responsible for damages from this accident.

  • That makes sense. ?We do have his insurance info and phone number, etc. ?I've always gone through insurance for all accidents and have never dealt with that so it's nice to get some perspective.

  • Tiff I agree...make sure the mechanic checks EVERYTHING....a small accident could knock your whole car out of whack.  Usually it does not, but be sure they check it all out!
  • Something else to keep in mind is that it is totally your decesion, not his. If he is being unreasonable and trying to have you get 3-5 estimates or only wants you to take your car to his brother's shop or anything that seems fishy, call his insurance company. Just make sure you feel good about it. Another thing is that if you were to handle it through his insurance they would pay for a rental car while your vehicle was in the shop being repaired. So if that is something you need, you might want to negogiate that with him. Although, a simple repair shouldn't take more than a couple of days. Oh, and one other thing, if you don't know where to take your car, call YOUR insurance and ask for their list of preferred shops. That way you know you are taking it to a quality place. For example, the company that I work for guarantees all work done by a preferred shop, for as long as you own the vehicle. That can be really important for large repairs. For a small rear-end accident it probably isn't a huge deal. But when you handle outside of insurance you give up that protection.
