questions about FMLA- teachers due over break

I am due the week before break. If I need to go on bed rest which it is looking like I might, and I use FMLA, can it *pause* over my 3 week break, or is that included in my `12 weeks.

 I hate asking HR because I dont want them to think I am planning to go on bed rest... I have just had a rough couple of weeks and could see it happening.

  • You'd have to ask because it all depends on the school system. I'm due in November, but our Christmas 2 weeks and our February week vacation do not count towards my maternity leave ?-however one day holidays do. On the other hand, my cousin's Christmas break counts if she goes out any time the week before. I hate to say it but just ask HR nonchalantly as if you are just curious. You don't have to mention anything about bed rest or having to be out.

  • I would ask, my 12 weeks have to be consistent.
  • no, FMLA does not pause. ?it runs concurrent to your short term leave... and in some cases lasts a bit longer. ?just because a company / school district goes on holiday does not mean that leave policies "pause".

    fwiw, it's a totally valid question to ask HR so that you as the beneficiary of those benefits fully understands what is you are receiving. ?Smile

  • it really does vary from district to district. I am at a private school so my STD only covers my contract days. It really depends on the coverage your district purchased. my archdioses went for the slim to non kind of plan...

    just ask they have to understand you have questions and need to plan for the worst. You have to do what is best for you in the long run

  • I'm a teacher and in the same exact situation, but I'm due xmas day.  I asked our HR person and the weeks are included in leave.  so im praying this baby stays in until 12/23(our last day before break.  that way my leve will start on 1/5/09, our first day back to school.  otherwise i "lose" the weeks.
  • It shouldn't vary from district to district.  The policy should be the same in all schools b/c the FMLA regulations state that school breaks where employees are not expected to report to work for 1 or more weeks (winter break, summer vacation, etc) do not count towards the 12 weeks of FMLA leave.

  • My school only counts work days. So, like during spring break, I'll be gone-but those days won't count against me.

    You'll need to ask though.

  • My school told me that HR will automatically adjust the weeks so that it is only used on days that I would actually be working normally.  So breaks don't count.
